David’s practice focuses on commercial litigation, with extensive involvement in complex insurance coverage disputes. He frequently advises clients on the coverage implications of claims made under Errors and Omissions, Directors and Officers, Commercial General Liability, and similar professional liability and commercial policies, including breach of fiduciary duty and other professional obligations, bodily injury and property damage related to construction accidents, personal and advertising injury, bad faith, construction defects, employment-related liability, products liability, auto liability, and fraud. David represents insurers in the defense and prosecution of lawsuits seeking judicial determinations of coverage, and has drafted hundreds of coverage opinions for clients seeking analysis of legal issues. He also prosecutes actions for recovery of premium, including those based on retrospective calculations. In addition, David has considerable general commercial litigation experience in employment-related issues, bankruptcy, fraud, and general business and contractual disputes, which he litigates before State and Federal Courts and arbitration tribunals throughout New York.
